2. Acceptance of These Terms
These Terms and Conditions apply when you visit our website, create an account, place an order, download a product, or otherwise use our services.
By placing an order, you confirm that:

- You understand that the products are supplied digitally; and

Product preview images may be displayed using mock-ups for presentation purposes. Unless specifically stated otherwise, mock-up items such as T-shirts, frames, mugs, packaging, backgrounds, or display scenes are not included in the purchase.
Colours may appear differently depending on the customer’s monitor, printer, ink, material, software, and production method. These reasonable variations do not mean that a different physical product will be supplied, because the purchased item is the digital file itself.
Nothing in this section limits your legal rights where digital content is faulty, materially misdescribed, or not supplied as promised.
6. Software and Compatibility
You are responsible for confirming that you have suitable software, equipment, and technical knowledge to open and use the file formats listed on the product page.
We do not guarantee that every file will be compatible with every application, cutting machine, printer, device, operating system, or production method.
Where we have incorrectly described a file format or compatibility requirement, please contact us so that we can investigate and provide an appropriate remedy.
7. Prices and Currency

The currency of the transaction will be clearly shown before you place the order. The total amount payable, including any applicable taxes, will be shown before the purchase is completed.

- We send an order confirmation or make the purchased file available to you.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- Payment has not been authorised;
- Incorrect or incomplete information has been supplied;
- Fraudulent or unauthorised activity is reasonably suspected;
- A pricing or technical error has occurred;
- The purchase breaches these Terms; or
- We are legally or contractually prohibited from completing the transaction.
Where we cancel a paid order before valid digital content has been supplied, the payment will be refunded through the original payment method.
9. Payments
Payments are processed through authorised third-party payment-service providers.
You confirm that:
- You are authorised to use the selected payment method;
- The billing information supplied is accurate; and
- The payment is not connected to fraudulent or unlawful activity.
We do not directly store complete payment-card details where those details are securely collected and processed by our payment-service provider.

10. Digital Delivery
After successful payment and order acceptance, the purchased digital content will normally be made available through one or more of the following methods:

- Another electronic-delivery method explained on the product page.
Customers are responsible for providing a correct and accessible email address.
If you do not receive your digital product, please:
- Check your email spam or junk folder;

- Check your customer account, where applicable; and

We will take reasonable steps to investigate and resolve genuine delivery problems.
Any download limit, access period, or expiry date applicable to a product will be displayed on the product page, customer account, order confirmation, or download notice.
11. Consumer Cancellation Rights for Digital Content
Consumers purchasing online may normally have a 14-day cancellation period. However, special rules apply where digital content is supplied immediately.
Where you request immediate access to digital content, you will be asked before payment to:
- Give your express consent for supply of the digital content to begin during the 14-day cancellation period; and
- Acknowledge that your right to cancel will be lost once downloading, access, streaming, or supply of the digital content begins.
Once you have given that consent and acknowledgement and the digital supply has started, you will no longer have a change-of-mind right to cancel that purchase.
This does not remove your legal rights where the digital content is faulty, not as described, or otherwise fails to meet applicable consumer-protection requirements.
UK rules require express consent and acknowledgement before the cancellation right is lost when digital supply begins during the cancellation period.
12. Refunds and Remedies
Because our products are digital and can be accessed or downloaded after purchase, we do not normally offer refunds merely because a customer:
- Changes their mind after digital supply has begun;
- Purchases the wrong product;
- Does not have suitable software;
- Does not read the product description;
- No longer requires the product; or
- Lacks the technical knowledge needed to use the listed file format.
However, we will investigate refund or remedy requests involving circumstances such as:
- Duplicate payment for the same order;
- Failure to provide access to the purchased product;
- A corrupted or unusable file that we cannot repair or replace;
- Receipt of a materially different product from the one described;
- An incorrect file being supplied; or
- A refund or remedy required by applicable law.
Depending on the circumstances, an appropriate remedy may include:
- Technical assistance;
- A replacement file;
- Repair or correction of the file;
- Restored download access;
- A price reduction; or
- A full or partial refund.
Digital content supplied to UK consumers must be of satisfactory quality, fit for its stated purpose, and match its description. These rights cannot simply be removed by writing “all sales are final.”

Purchasing a digital product does not transfer ownership of the artwork or its intellectual-property rights to you.
Unless the product page or accompanying licence states otherwise, your purchase grants you a limited, non-exclusive, non-transferable licence to use the purchased digital file according to the permitted uses stated for that product.
The exact licence shown on the product page or supplied with the downloaded file forms part of these Terms.
Personal Use
Where personal use is permitted, you may use the design for your own non-commercial projects and finished personal items.
Commercial Use
Commercial use is permitted only where the product page or accompanying licence expressly states that commercial use is included.
Where commercial use is permitted, you may use the design to create finished products for sale within the limits stated in the applicable product licence.
Print-on-Demand Use
Uploading a design to a print-on-demand service is permitted only where the relevant product page or licence expressly allows print-on-demand use.
14. Prohibited Uses
Unless we provide prior written permission, you must not:
- Resell, redistribute, share, exchange, or give away the original digital files;
- Upload the original files to another digital-download website, marketplace, drive, group, or membership library;
- Sell the digital file in its original or substantially unchanged form;
- Claim that you created or own the original artwork;
- Transfer or sublicense your licence to another person;
- Make the original files available for others to download;
- Convert the file into another format for resale as a digital product;
- Use previews, mock-ups, or website images as the purchased product;
- Register the artwork, or a confusingly similar version, as your own copyright or trademark;
- Use the artwork in unlawful, fraudulent, defamatory, hateful, or abusive material;
- Remove copyright, licence, or ownership notices supplied with the file; or
- Use the product beyond the limits stated in its licence.
Employees, contractors, printers, or production partners may access a file only where reasonably necessary to create an authorised finished product for the purchaser. They must not retain, reuse, sell, or distribute the file independently.
15. Intellectual Property
Unless otherwise stated, the website, branding, product artwork, product previews, written content, graphics, layouts, logos, and downloadable files are owned by or lawfully licensed to ART CARNIVAL LTD.
All applicable copyright and intellectual-property rights are reserved.
You may not copy, scrape, reproduce, publish, modify, distribute, or commercially exploit website content except as allowed by the licence supplied with a purchased product or with our written permission.
16. Customer-Supplied Information
You are responsible for ensuring that the information supplied during checkout is accurate.
We are not responsible for delays or access problems caused by:
- An incorrect email address;
- An inaccessible email account;
- Customer-side spam filtering;
- Failure to retain order details;
- Unsupported software;
- Device or internet problems; or
- Unauthorised access caused by the customer’s failure to secure their account.
This section does not apply where the problem was caused by our own failure to supply the purchased content correctly.
17. Fraud, Misuse, and Unauthorised Transactions
We may suspend access, withhold digital delivery, or cancel an order where we reasonably suspect:
- Payment fraud;
- Card testing;
- Unauthorised payment activity;

- Printing or manufacturing decisions made by the customer or a third party;
- Variations caused by printers, inks, materials, screens, or production settings; or
- Unauthorised sharing or misuse of the purchased file.
Where you are purchasing as a consumer, these Terms do not limit your mandatory statutory rights.
Where you purchase wholly for business purposes, our total liability relating to a particular order will not exceed the amount paid for that order, except where liability cannot legally be limited.
